General Terms of Use and Purchase

1. Information prior to the contractual process

This website www.weareaurei.com (hereinafter, the "Website") is owned by INIOKOMACHI SL, with Tax Identification Number B23964729, trading under the brand name Aurei (hereinafter, "Aurei"). Contact email address: info@weareaurei.com.

These General Terms and Conditions of Purchase (hereinafter, the "Terms") govern the distance-selling relationship between Aurei and the User or customer, in accordance with Spanish Law 7/1998 of 13 April on General Terms and Conditions of Contracting; Royal Legislative Decree 1/2007 of 16 November approving the Consolidated Text of the General Law for the Protection of Consumers and Users, as amended by Law 3/2014; Law 7/1996 of 15 January on Retail Trade; Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSI-CE); and the legislation in force regarding the protection of personal data.

Aurei reserves the right to amend these Terms at any time. Such amendments shall become binding upon publication on the Website and shall not affect orders already confirmed beforehand.

Purpose: the online sale of sportswear, fashion accessories and lifestyle products (activewear) under the Aurei brand, marketed through a limited-edition launch system ("drops").

The duration of the contract is linked to the delivery of the product, without prejudice to the right of withdrawal regulated in section 7.

2. Drop system and product availability

Aurei markets its collections through periodic, limited-edition launches ("drops"). Each drop is published on the Website together with the sizes, colours and quantities available at the time of launch. Once a particular item, size or colour is sold out, Aurei does not guarantee that it will be restocked, although occasional restocks may be announced through the Website or its official channels.

If, due to an error or exceptional circumstance, a purchased product is unavailable after the order has been confirmed, Aurei will notify the User by email within a maximum period of 30 days, offering the option of replacing it with a product of similar characteristics or receiving a full refund of the amount paid.

3. Registration and purchasing process

To purchase products through the Website, the User must be over 18 years of age and have the legal capacity to enter into a contract.

By completing the purchasing process, the User declares that the information provided is true and relates to them personally, and accepts these Terms and the Privacy Policy. The contract shall be deemed concluded when the User clicks the "Pay" button or equivalent, after correctly completing all steps of the purchasing process.

Once the order has been completed, the User will receive confirmation by email. If no confirmation has been received within 24 hours, the User should contact Aurei at info@weareaurei.com.

4. Prices

All prices shown on the Website are expressed in euros (€) and include the legally applicable Value Added Tax (VAT). If any other indirect tax applies (IGIC, IPSI), this will be expressly indicated during the purchasing process.

Aurei reserves the right to change its prices at any time; however, products will be invoiced at the prices applicable at the time the order is placed.

5. Shipping costs and delivery times

AUREI offers domestic and international shipping. Shipping costs and estimated delivery times vary depending on the destination of the order.

The shipping rates and estimated delivery times currently established are as follows:

  • Spain – Mainland: €6.90. Estimated delivery time of 2 to 4 business days.
    Free shipping on orders over €150.

  • Spain – Balearic Islands: €9.90. Estimated delivery time of 3 to 5 business days.

  • Spain – Canary Islands: €11.90. Estimated delivery time of 3 to 5 business days.

  • Portugal – Mainland: €6.90. Estimated delivery time of 2 to 4 business days.
    Free shipping on orders over €150.

  • Europe: €19.90. Estimated delivery time of 3 to 5 business days.
    Free shipping on orders over €250.

  • Rest of Europe: €24.90. Estimated delivery time of 3 to 5 business days.
    Free shipping on orders over €250.

  • United Kingdom: €24.90. Estimated delivery time of 3 to 5 business days.

  • United States and Canada: €59.90. Estimated delivery time of 5 to 8 business days.

  • Rest of the world: €79.90. Estimated delivery time of 5 to 8 business days.

The delivery times indicated are estimates and are calculated in business days. These delivery times may be affected during periods of high demand, promotional campaigns, public holidays, or due to circumstances beyond the control of AUREI or the shipping companies responsible for delivery.

The applicable shipping costs will always be displayed during the checkout process, before the order is confirmed and paid for, based on the delivery address provided by the customer.

For orders shipped outside the European Union, taxes, duties, customs fees or other import charges imposed by the authorities of the destination country may apply. Where applicable and unless expressly included during the checkout process, these charges shall be the responsibility of the recipient.

Once the shipment has been confirmed, the User will receive an email containing the order tracking number.

6. Payment methods

The User may pay for their order using:

  1. Credit or debit card (Visa / Mastercard)
  2. PayPal

All transactions involving the transmission of personal or banking information are carried out in a secure environment using SSL/TLS protocols. Card details are entered directly into the payment gateway and are not stored or recorded on Aurei's servers.

If the amount of a purchase has been charged fraudulently or incorrectly through the unauthorised use of a payment card, the cardholder may request the immediate cancellation of the charge, and the corresponding debit and credit adjustments shall be made as soon as possible.

7. Right of withdrawal

In accordance with Article 102 and the following provisions of the Consolidated Text of the General Law for the Protection of Consumers and Users, a User acting as a consumer shall have a period of 15 calendar days from receipt of the product to withdraw from the contract, without having to provide any justification and at no cost.

To exercise the right of withdrawal, the User must notify Aurei unequivocally by email at info@weareaurei.com, stating their decision to withdraw from the contract.

Exceptions to the right of withdrawal: in accordance with Article 103 of the aforementioned legislation, sealed goods which are not suitable for return due to health protection or hygiene reasons and which have been unsealed after delivery are excluded from this right. In particular, socks cannot be returned or exchanged once their original packaging or seal has been removed, except in the event of a manufacturing defect.

8. Exchanges and returns

Without prejudice to the statutory right of withdrawal described in the previous section, Aurei offers its customers the possibility of returning products under the following conditions:

  1. Period: 15 calendar days from receipt of the order.
  2. Cost: free of charge for the User.
  3. Condition of the product: the garment must be in perfect condition, unworn, with the original tags attached and, where applicable, with any hygiene seal or tag intact.
  4. Excluded product: socks cannot be returned or exchanged, except in the event of a manufacturing defect, as they are considered an intimate garment subject to hygiene requirements.

To request a return, the User must contact Aurei at info@weareaurei.com, stating the order number and reason for the return. Aurei will provide the instructions required to complete the process.

Once the returned product has been received and verified as being in perfect condition, Aurei will refund the corresponding amount using the same payment method used for the purchase, within an estimated period of 7 to 10 business days from receipt of the return.

Defective product: if the product received has a defect that is not attributable to the User, the User shall be entitled to return it free of charge by informing Aurei of the reason at info@weareaurei.com. Aurei undertakes to cover the return shipping costs and to replace the product with a new one or refund its value, in accordance with the conditions accepted at the time of purchase.

9. Warranties

All products sold by Aurei are covered by the statutory warranty provided for under applicable consumer protection legislation. To exercise this right, the User may contact info@weareaurei.com.

10. Intellectual and industrial property

Aurei owns, either directly or as an assignee, all intellectual and industrial property rights relating to the Website and the elements contained therein (including, but not limited to: images, texts, trademarks, logos, colour combinations, structure, design and computer software required for its operation). These elements are protected by Spanish and European Union intellectual and industrial property legislation, as well as by international treaties signed by Spain.

The reproduction, distribution, public communication or transformation, in whole or in part, of the contents of the Website for commercial purposes, by any means or on any medium, is expressly prohibited without Aurei's prior authorisation.

The User may view the elements of the Website and may even print, copy and store them on their device exclusively for personal and private use.

11. Liability and links

The User is responsible for the proper use of the Website, including the accuracy of the information provided in forms and the lawful use of the information, services and content offered.

Aurei accepts no responsibility for the content of external websites that may be linked to from the Website, nor does it guarantee their availability, accuracy or legality.

Aurei declares that it has adopted the necessary measures to prevent harm to Users arising from browsing the Website; nevertheless, it shall not be liable for any damage resulting from circumstances beyond its control.

12. Amendments

Aurei reserves the right to make, without prior notice, any changes it deems appropriate to the Website, including changing, removing or adding content and services, as well as changing the way in which they are presented or located.

13. Jurisdiction and dispute resolution

These Terms are governed by Spanish law. Where the User acts as a consumer, the competent court shall be either the court corresponding to the User's place of residence or the court corresponding to Aurei's registered office, at the consumer's choice. In the case of commercial contracts between professionals, the parties submit to the jurisdiction of the courts of Barcelona, expressly waiving any other jurisdiction that may otherwise apply.

In accordance with Article 14.1 of Regulation (EU) No 524/2013, Users are hereby informed that the European Commission provides an online dispute resolution platform, available at the following link: https://ec.europa.eu/consumers/odr/.

14. Severability

If any clause of these Terms is declared null or invalid by a competent authority, that clause shall be deemed not to form part of the Terms, without affecting the validity and enforceability of the remaining provisions.

15. Data protection

The processing of personal data provided by the User is governed by our Privacy Policy, available on the Website.
